ANTICOMPETITIVE REAL ESTATE COMMISSIONS & THE THEORY BEHIND A “BAD BIDDERS LIST”

A discussion about the pros vs. cons of a “bad bidders list” as well as recent movement on the Federal class action lawsuit that could upset the real estate industry.

As the auction industry heads more and more towards online bidding platforms, the experience with unscrupulous bidders will unfortunately become more prevalent.   In this episode we discuss this issue with Mike Brandly and his recent blog post regarding the challenges to creating a “Centralized Bad Bidders List”.   We also talk about the recent movement of a Federal Court case that is looking at the National Association of Realtors and some Multi-list Systems (MLS) on the grounds that they may have attempted to force sales commission structures on Sellers, that obligate them to pay for the Buyer’s representation.  There is a LOT of information in this episode, so enjoy the show.
